Terms of Service

1. Acceptance of Terms
By accessing or using the Spelers Pro platform (“Service”) you agree to be bound by these Terms of Service (“Terms”). If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree, do not use the Service.
2. Description of Service
Spelers Pro provides an AI automation platform enabling businesses to deploy conversational AI agents across voice, WhatsApp, and web chat channels. Features include agent configuration, conversation analytics, CRM integrations, and billing management. We reserve the right to modify, suspend, or discontinue any feature with reasonable notice.
3. Account Registration
You must provide accurate and complete registration information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at support@spelerspro.com if you suspect unauthorised access. We may suspend accounts that violate these Terms without prior notice.
4. Acceptable Use
You agree not to use the Service to: transmit spam or unsolicited communications; engage in deceptive, fraudulent, or illegal activities; scrape or reverse-engineer the platform; generate, store, or distribute content that is unlawful, harmful, or violates third-party rights; or interfere with platform infrastructure. We may terminate access for violations without refund.
5. Payment and Billing
Subscription fees are billed in advance on a monthly or annual basis. Usage-based overages are billed in arrears. All fees are non-refundable except as required by law. We may update pricing with 30 days' notice; continued use after the notice period constitutes acceptance of new pricing. Failure to pay may result in service suspension.
6. Intellectual Property
Spelers Pro and its licensors retain all rights, title, and interest in the platform, software, and associated intellectual property. You retain ownership of your data and content. You grant us a limited licence to process your data solely to provide the Service. Nothing in these Terms transfers ownership of either party's intellectual property.
7. Limitation of Liability
To the maximum extent permitted by law, Spelers Pro shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data loss, arising from your use of or inability to use the Service. Our total aggregate liability for any claim shall not exceed the fees paid by you in the 12 months preceding the claim.
8. Termination
Either party may terminate these Terms on 30 days' written notice. We may terminate immediately for material breach, non-payment, or conduct that exposes us to legal liability. On termination, your access ceases and we will delete your data in accordance with our Privacy Policy. Sections 6, 7, and 9 survive termination.
9. Governing Law
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Amsterdam. If any provision is found unenforceable, the remainder continues in full force.
